Agartala, Aug 19 (FD) The Tripura Human Rights Commission (THRC) has sought a detailed report from the Director General of Police (DGP) over serious allegations of illegal detention, harassment and coercion against personnel of Bishalgarh Police Station in Sepahijala district.
The Commission has directed the DGP to conduct an inquiry into the allegations and submit a report before it by September 29, when the matter is scheduled for further hearing.
The case arose from a complaint filed by Sadhan Paul, a resident under R.K. Pur Police Station in Gomati district, against the Officer-in-Charge and other personnel of Bishalgarh Police Station.
According to the complaint, Paul's son, Susanta Paul, was allegedly detained by police personnel around noon on August 4. The complainant alleged that neither his son nor other family members were informed about the grounds for the arrest and that Susanta was kept in police custody for more than 24 hours before being produced before the SDM, Bishalgarh, on August 6.
The Commission observed that, if established, the allegations could amount to a violation of the fundamental rights guaranteed under Articles 21 and 22(2) of the Constitution.
The complaint also raised allegations of harassment and coercion against police personnel. Sadhan Paul alleged that when he visited Bishalgarh Police Station to inquire about his son, he was insulted and subjected to mental harassment.
More seriously, he alleged that police personnel brought the manager of Satin Creditcare Network Limited and his associates to the police station and pressured him into signing a declaration agreeing to refund Rs 4 lakh to certain persons who had allegedly taken loans from the financial institution.
Paul maintained that he was neither a borrower nor personally liable for the loans and alleged that the police had intervened in what was essentially a financial dispute.
The Commission noted that the recovery of monetary claims is generally subject to civil remedies and observed that police authority cannot be used to compel an individual to discharge another person's alleged financial liability.
Sadhan Paul has also sought preservation and examination of CCTV footage from Bishalgarh Police Station, along with relevant general diary entries, arrest memos, forwarding reports and the case diary connected with the alleged incident.
After examining the complaint, the THRC decided that a report from the DGP was necessary before proceeding further. The DGP has been requested to inspect the available CCTV footage and, if possible, submit the relevant recordings before the Commission.
The development has put the Bishalgarh Police Station under the scrutiny of the State Human Rights Commission, with the DGP's inquiry report expected to determine the next course of action in the case. FD JK
